Terms of Service

By engaging in my services, be it by commission or obtaining secondhand ownership of any of my works, you automatically agree to abide by all of the following terms and policies.

General Terms

  • Commissioned artwork is digital only, there will not be any shipping of physical goods.

  • I reserve the right to cancel or refund your commission at any time.

  • My prices and terms are subject to change without further notice.

Permissions & Usage

  • Commissioned artwork is for personal/private use only.

  • I, the arrist, retain absolutely all rights and copyrights to my commissioned works, meaning I have the right to publish, advertise, share, and otherwise distribute my work in any way unless private use is arranged with the client beforehand.

  • No one is authorized to alter, copy, or trace my artwork, or remove, obscure, or crop out my watermark from my artwork in any capacity. Commissioners/owners of my art may use their piece as icons, profile banners, or any other personal, non-commercial, branding whilst still providing explicit credit.

  • I do not authorize reposts of my art unless it is the person's own commissioned piece; explicit credit linking back to the me (e.g. "commission from @dogebf") is expected when reposting.

  • Under absolutely no circumstances is any person or entity authorized to mint my work as an NFT (Non Fungible Token), commissioned or otherwise, as well as feed my artwork into AI generation software for any purpose. Any existing instances of such are unauthorized, copyright infringement, and blatant theft.

Special Usage Fees

  • The compensation fee for a private commission (art that will not be shared on any sites nor used for my own promotion) is +150% (or + x1.5) on top of the final price of your commission.

Payment & Order Process

  1. To order a commission, please DM me on any of my active platforms with your REFERENCE SHEET, PROMPT, and PAYPAL EMAIL. I will get back to you if I accept your commission.

  2. Payment is to be accepted in full and up-front through a PayPal invoice in USD before any work is started. If the expected payment is not made within 24 hours, your slot will be canceled for someone else to fill.

  3. After the payment is made, I will send you a confirmation sketch. Requesting revisions and adjustments to a piece are only to be made in this stage. After a sketch is decided on, I work to completion and will not edit any further, unless I have made a mistake.

  • Please be mindful and aware before commissioning me that your commission may take considerably longer if there are commissions before yours in my queue.

  • Turnarounds may vary, but pieces are usually completed within 1-3 months.

Refund Policy

  • If I feel like I can not complete your commission for any reason, I will personally issue you a full refund no matter what stage your commission is in.

  • If after 30 days since initial payment I have not started your commission, you may request a complete refund. I will not do any refunds before then.

  • 70% of the total price can be refunded in the sketching phase.

  • 30% of the total price can be refunded in the lining phase.

  • NO refunds are given beyond the lining phase or if the commission is completed.

  • If an agreed upon refund is issued before completion, you have the option to keep any work done (sketches, lines, etc.)

  • All digital character purchases are non-refundable.

  • Any deposits/payments made towards a payment plan are non-refundable.

  • Chargebacks are not allowed under any circumstance. If a chargeback is issued for any reason, you will lose ownership rights to all work done and will be blacklisted.

Character Design/Adopt Terms

By obtaining ownership of one of my designs, be it firsthand, secondhand, or any other given means,
you automatically agree to abide by all of the following terms and policies.

General Design Terms

  • I, the artist, will always retain all intellectual rights and copyrights over my designs. When ownership is transferred, you are obtaining the rights to use the design for private/personal use.

  • You may not not override your own/another artist's terms or rules over mine.

  • You may slightly alter the original file of a design you own by me, on the condition that:

  • The original design file must not be deleted.

  • You may redesign the character without limitations on your own/commissioned art.

  • When making changes to a design, you must still credit me as the creator.

  • Do not split redesigns into different characters in order to sell separately.

  • You may not “breed”/make “litters”, or split designs into different characters for any reason.

  • Do not delete my designs from Toyhou.se, even if sold off-site.

  • I can provide Toyhou.se codes to off-site buyers of my designs at no cost.

Design Ownership & Transfer

  • You may not sell my designs for more than what you paid for. Additionally:

  • Artwork created or purchased by you may count towards a design's monetary value.

  • Artwork received through trades or gifts/"freebies" do not add monetary value.

  • Characters received through gifts, giveaways, or raffle prizes may not be resold, only traded.

  • The value of my design does not change to the value of a different character's when traded.

  • Designs are revoked if the payment is never received or if a chargeback is issued.

  • Violating any other TOS may blacklist you from any future design ownership or transactions.

Commercial Use of Designs & Royalties

  • When obtaining a design from me, you own all rights to profit off of the character but NOT the rights to profit off of my original artwork. You can profit off of the character's design via your own art, commissions, fursuits, reselling the character, etc.

  • I do not permit commercial usage (i.e. in video games, brand mascots, any kind of merch, etc.) of my designs.

Please make sure that you've fully read my Terms of Service before commissioning me.
Please also read my 'wills and won'ts' below before sending me your prompt.

Prices

These prices are reflective of work intended for personal use.
Commercial projects such as: game art, album covers, apparel designs, stickers, pins, or anything else intended to generate the client revenue are subject to a different pricing.
